1. General
Clause 1.1
The protection of privacy and personal data is very important to Punfyre BV. This Privacy Statement has been drawn up to inform data subjects about how Punfyre BV handles personal data in the context of Alarmira and how data subjects can exercise control over their personal data. It is recommended that those involved read this Privacy Statement carefully before using the Alarmira website, products and/or services.
Clause 1.2
The controller for the processing of personal data is Punfyre BV, with registered office at Vlamingstraat 4, 8560 Wevelgem (Belgium).
Clause 1.3
This Privacy Statement regarding data processing has been drawn up in implementation of the General Data Protection Regulation, other European regulations containing provisions relating to data protection and privacy, as well as the applicable national legislation on data protection and privacy and the implementing decrees.
2. Definitions
“General Data Protection Regulation” or “GDPR” is Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC.
“Alarmira” is the digital alarm button with associated application from Punfyre BV so that its users can quickly and accurately notify the right contact persons in an emergency situation to obtain assistance.
“Data Subject(s)” is/are the person(s) whose personal data is processed in the context of the Alarmira website, products and services.
“Personal data breach” is a breach of security that leads to the accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to, personal data transmitted, stored or otherwise processed.
“Private users” are the customers of Punfyre BV who use the digital alarm button and associated services from Alarmira.
“Personal data” is any information about an identified or identifiable person, i.e. the data subject.
“Processing” is any operation or set of operations which is performed on personal data or on sets of personal data, whether or not carried out by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction of data.
“Controller” is Punfyre BV, which determines the purposes and means of processing personal data for Alarmira.
3. The personal data collected
Clause 3.1
The following personal data is collected by Punfyre BV – in the context of the Alarmira website, products and services:
- Category 1: the ordinary personal data of the data subjects:
- Category 1.1: the IP address, first and last name, address, billing address (optional), e-mail address, address and mobile number of visitors to the Alarmira website and/or of (potential) customers.
- Category 1.2: the first and last name, address, e-mail address, mobile number and location (GPS coordinates) of the private users.
- Category 1.3: the first and last name, e-mail address, mobile number and the status of the contact persons of the private users.
- Category 2: the special identification data of the data subjects:
- Category 2.1: facial recognition, voice (optional) and medical data (optional) of private users.
Clause 3.2
The aforementioned personal data is collected for the following purposes:
- Category 1.1: (i) to ensure the proper functioning and optimization of the Alarmira website that (potential) customers visit, (ii) to realize purchases of the alarm button with associated Alarmira subscription services via the website and (ii) to send out newsletters.
- Category 1.2 and 2.1: (i) to register private users with Alarmira's services via the application and (ii) to ensure that private users can use Alarmira's services.
- Category 1.2, 1.3 and 2.1: (i) to activate the alarm button and (ii) to ensure that private users can use the alarm button and/or additional safety functions of Alarmira.
Clause 3.3
Consent is requested from the data subjects for the processing of the special identification data of the data subjects (category 2.1) by Alarmira. The data subjects also undertake to only store the contact details of the contact persons (category 1.3) in the Alarmira application if they have the contact person's agreement to do so. Under no circumstances can Punfyre BV be held liable for the unlawful use of the personal data of a contact person by a data subject.
4. The purposes of the processing
4.1 Delivery and operation of Alarmira products and services
The processing of personal data is necessary for (i) the purchase of the alarm button with associated subscription services from Alarmira, (ii) the ability to easily contact the data subject as a customer, (iii) the delivery of the alarm button with associated subscription services to the customer, (iv) the preparation and sending of an invoice to the customer and (v) the proper functioning of the alarm button with associated subscription services from Alarmira.
4.2 Statistical reasons
The processing of ordinary personal data for statistical reasons takes place exclusively for the evaluation of the operation of the Alarmira website and the optimization of the internal operation and the products and services of Alarmira.
4.3 Transfer to third parties
Punfyre BV calls on third parties to carry out and enable Alarmira's services, in particular for:
- realizing emergency services;
- providing web hosting services;
- helping to improve and optimize the operation of the Alarmira website;
- realizing the online purchase of a product and/or service from Alarmira via the webshop.
Depending on the chosen subscription with alarm follow-up, the data subject can rely on alarm follow-up by Securitas Alert Services NV. In that case, Securitas Alert Services NV will process the personal data of the data subject and the privacy statement of Securitas Alert Services NV applies. The data subject acknowledges that he/she has taken note of the privacy statement of Securitas Alert Services NV.
4.4 Legal obligations
In the event of a court order or to comply with other mandatory laws or regulations, Punfyre BV may disclose personal data. Those involved will be informed about this, unless this is subject to legal restrictions.
4.5 Commercial transfer and contractual protection
Punfyre BV does not sell or rent the collected personal data, nor does it distribute or make the personal data commercially available to third parties. Punfyre BV guarantees a similar level of protection by making contractual obligations enforceable on appointees, which are similar to this privacy statement and guarantee that the duty of discretion is respected at all times.
5. The duration of the processing
Punfyre BV stores and processes the personal data for the period for which it is legally obliged to do so or for as long as this is essential for the purposes of the processing or for the contractual relationship with the data subjects.
6. The rights of the data subject
6.1 Right of access and inspection
The data subject has the right to inspect his or her personal data and its use by Punfyre BV at any time.
6.2 Right of correction, deletion and limitation
The data subject is free not to communicate certain personal data to Punfyre BV. The data subject always has the right to request Punfyre BV to amend his Personal Data. The data subject may also request that the processing of specific personal data be restricted if the data subject believes that such data is inaccurate. In addition, the data subject has the right to request Punfyre BV to delete specific personal data. If the data subject refuses to provide certain personal data or requests to delete specific personal data, Punfyre BV may no longer be able to provide specific products and/or services from Alarmira (optimally).
6.3 Right to object
The data subject has a right to object to the processing of his/her personal data if he/she has serious and legitimate reasons for doing so.
6.4 Right of free data transfer
The data subject has, within certain limits, the right to receive his or her personal data processed via the Alarmira website in a structured, commonly used and machine-readable format and/or to have them transferred to other controllers.
6.5 Right to withdraw consent
The data subject has the right to withdraw his prior consent to the processing of his personal data.
6.6 Rights regarding automated decisions and profiling
The data subject has the right to request Punfyre BV not to be the subject of a decision based solely on automated processing, including profiling, which produces legal effects relating to or significantly affecting the data subject.
6.7 Exercise of rights
The data subject can exercise his/her rights by contacting Punfyre BV and attaching a copy of his/her identity card to this request.

6.8 Complaints law

This does not affect a provision before a civil court. If the data subject suffers damage as a result of the processing of his or her personal data, the data subject can file a claim for damages.
7. Security and Confidentiality
7.1 Technical and organizational security measures
Punfyre BV has developed security measures that have been adapted at a technical, administrative and organizational level to prevent the destruction, loss, falsification, modification, unauthorized access or mistaken notification to third parties of personal data, as well as any unauthorized processing of this data. In the event that an aforementioned infringement does occur and this concerns personal data, Punfyre BV will inform the data subject about the infringement, including a description of the potential impact and a recommendation to limit the possible negative consequences of the infringement.
7.2 Hosting and data storage within the EEA
Punfyre BV provides a safe environment, controlled by the data subject, for the use of the Alarmira website and application. Punfyre BV stores personal data securely on servers located within the European Economic Area.
7.3 Limitation of liability in case of misuse by third parties
Under no circumstances can Punfyre BV be held liable by a data subject for any direct or indirect damage resulting from incorrect or unlawful use of personal data by a third party.
7.4 Responsibilities of the data subject for account security
The data subject is responsible for maintaining the privacy and security of the Alarmira application. For example: by not allowing a third party to use their personal login and by avoiding all unauthorized access to their account. The data subject alone is liable for the use of the Alarmira application on the devices/devices, IP address and identification data, as well as for their confidentiality.
7.5 Reporting obligation in case of unauthorized account use
The person concerned must immediately inform Punfyre BV of unauthorized use of his account by sending an e-mail to info@alarmira.com .
8. Applicable law and competent courts
This privacy statement shall be governed exclusively by and construed in accordance with applicable Belgian law without regard to any conflict of law or rule. The courts and tribunals of the judicial district of West Flanders, Kortrijk department, have exclusive jurisdiction if a dispute arises regarding the interpretation or implementation of this privacy statement.
